The General Conditions apply to transactions carried out on this website from the date of publication, and shall refer to the products purchased at the time these conditions were available, remaining in force thereafter in all that is provided therein on a permanent basis.
The use of this website confers to the user the condition of User and, therefore, is bound by our General Terms and Conditions. If you do not agree with any of these documents, please do not use this website.

By placing an order through this website, the User declares to be over 18 years of age and to have the legal capacity to enter into contracts.

All products offered are shown in detail on the website, within the corresponding sections, differentiated by product categories. If there are differences between the image and the written product sheet, the description in the product sheet shall always be considered valid.
All our products are manufactured in compliance with the applicable regulations on cosmetic products, and do not include products or substances prohibited under the terms indicated by law. Likewise, our products comply with the labeling and consumer information regulations, including, when necessary, the pertinent instructions and indications for their correct use and the appropriate warnings. However, we will be pleased to answer your questions about our products or manufacturing processes through the above mentioned e-mail address.
To place an order, it is necessary to follow the online purchase procedure, filling in all the fields that appear as mandatory.
The User will select on the Web the product that he/she wishes to acquire and the number of units, being thus introduced the order in the “Shopping Cart”. All the products include information of their characteristics and price, including the taxes applicable to the product.
In order to make the shipment, the User must provide the necessary data requested in the purchase form. The User will be responsible for the veracity of the personal data provided to PERICHE.
After the final validation of the order by PERICHE and by the chosen payment gateway, the User will receive an email confirming their order, containing the price, applicable taxes and, if applicable, shipping costs and delivery time, as well as information regarding the products purchased, as well as the tracking number of the order. The User shall keep the order confirmation as proof of the order.
The User will be able to correct errors related to the personal data provided during the purchase process through the e-mail
For its part, the Web has confirmation windows in each of the sections of the purchase process. Likewise, the Web offers the details of all the articles that the User has added to his shopping cart, so that, before making the payment, the User can check and, if necessary, modify the data of his order.
If the User detects errors in the order after completing the purchase process, he/she should immediately contact PERICHE at the email address indicated above, in order to correct the error before the order is processed.
PERICHE undertakes to deliver any order within the limit of available stock. In case of unavailability of the products ordered, the User will be informed as soon as possible and will have the possibility to cancel his order. In this case, he/she may receive a refund of the sums paid, within a maximum of 30 days from the date of payment.
Place of delivery: PERICHE serves its products within the European Union.
The products will be delivered to the User at the address indicated by the User at the time of placing the order with PERICHE, who will in no case be responsible in case of absence of the User from the address at the time of delivery of the products at the time of placing the order.
Except for special circumstances derived from the indications in the order of the products, or extraordinary circumstances derived from unforeseeable and irremediable events, the shipment of the orders consisting of the products indicated will be carried out within the period indicated in this or in the web page and, in any case, in a maximum of 30 days from the date of the Purchase Confirmation. Delivery will be made through the courier company designated by PERICHE at all times. No deliveries will be made on holidays.
The processing of the order may take up to two working days from the validation of the payment of the order by the bank. If for any reason we are unable to meet the delivery date, PERICHE will inform the User of this circumstance giving him/her the option to go ahead with the purchase by setting a new delivery date, or to cancel the order with a full refund of the price paid.
Delivery of the order shall be deemed to have occurred at the time the User, or a third party indicated by the User, acquires material possession of the products, which shall be evidenced by signing the receipt of the order and corroboration of identity by providing an identity document or similar supporting document, at the agreed delivery address.
If it is impossible for us to deliver the order, the courier company will arrange with you the delivery of the order. They will leave an informative note to the User explaining where your order is and how to have it resent to you. If you are not going to be at the place of delivery at the agreed time, please contact the courier company to change the delivery date as indicated in the Purchase Confirmation.
After 15 days have elapsed since the order is available for delivery, but it has not been delivered for reasons beyond PERICHE’s control and not attributable to PERICHE, we will understand that the User wishes to withdraw from the contract and we will consider it resolved. The transport derived from the cancellation may have an additional cost, so we will be authorized to charge the User the corresponding costs.
The User shall acquire ownership of the products upon receipt of full payment of all amounts due in connection therewith, including shipping costs, or upon delivery (as defined in the “Delivery” clause), if delivery takes place at a later time.
The risks of the products shall be borne by the User from the time of delivery.
The prices of the products are those listed on the website at the time the User places the order (including applicable taxes in each case).
Shipping costs will be indicated in the breakdown prior to shipment confirmation. All shipping charges may be subject to applicable taxes.
When the shipment is made to the peninsular area, shipping costs will be free on purchases over 40 euros. In lower purchases the shipping cost will be as indicated in the breakdown prior to the completion of the Order. These shipping costs may be subject to VAT.
If the shipment is made to a country of the European Union, the costs will be added to the total amount due, as indicated in the breakdown prior to placing the Order. Shipping costs will be indicated in the breakdown prior to confirmation of shipment. All shipping charges may be subject to applicable taxes.
Prices may change at any time, but any changes will not affect orders for which a Purchase Confirmation has already been sent.
Once selected the articles that the User wishes to buy, these will be added to his cart, and the following step will be to process the order and make the payment. To do this, the User must follow the steps of the purchase process, filling in or checking the information requested at each step. Likewise, during the purchase process, before making the payment, he/she will be able to modify the data of his/her order. All charges that will be made to the User will be detailed prior to the confirmation of the order, including the breakdown of prices and applicable taxes.
You may use as means of payment the means indicated on the website. PERICHE reserves the right to suspend the processing of the order in case of refusal of the payment authorization by the bank or payment institution in each case.
No other means of payment other than those specified directly on the website will be accepted. All transfers and payments made through the web are made through specific ports to ensure data protection. All data travels encrypted through the secure payment platforms of the gateways, and are not stored.
PERICHE guarantees the confidentiality of the data provided for the purchase of the products offered through the website and their treatment in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and to the Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights.
In accordance with the provisions of Article 68 of Law 37/1992 of 28 December 1992 on Value Added Tax, the delivery of the goods shall be deemed to be located in the territory where Spanish VAT is applicable. The applicable VAT rate shall be that legally in force at any given time.
In the event that the shipment is to a country within the European Union, the corresponding taxes will be applied depending on the country of delivery of the items.
The User expressly authorizes us to issue the invoice in electronic format, but may nevertheless request the invoice in paper format, in which case, we will send the invoice in this format.
Right of Withdrawal
The User, as a consumer and user, has the right to withdraw from this contract within 14 calendar days without justification, with the exception of the return costs. The withdrawal period shall expire 14 calendar days from the day on which the User, or a third party designated by the User other than the carrier, acquired material possession of the goods or; in the event that the goods making up the order are delivered separately, 14 calendar days from the day on which the User or a third party designated by the User other than the carrier acquired material possession of the last of those goods.
To exercise the right of withdrawal, the User must send a notification to PERICHE, by sending the withdrawal form by ordinary mail to the address indicated in the heading of these Purchase Conditions or by email to info@tempting.es indicating in the subject line his/her name and “EXERCISE OF THE RIGHT OF WITHDRAWAL”; his/her decision to withdraw from the contract through an unequivocal statement. You may use the withdrawal form attached as an Annex to these Conditions, although its use is not mandatory.
In order to meet the withdrawal deadline, it is sufficient that the communication concerning your exercise of this right is sent before the expiration of the withdrawal period.
In case of withdrawal by the User, we will refund all payments received, except shipping costs, without undue delay and, in any case, within 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment used by you for the initial transaction, without incurring any additional charges as a result of the reimbursement. However, we may withhold the reimbursement until we have received the goods, or until the User has provided proof of the return of the goods, whichever condition is met first.
The User must return or deliver the products to us without undue delay and, in any case, within 14 calendar days from the date on which he/she informs us of his/her decision to withdraw from the contract, by any of the aforementioned means. The deadline shall be deemed to be met if you return the goods before the deadline has expired and the products are in perfect condition.
The User shall bear the direct cost of returning the goods. In the event that the User decides to return the goods to us carriage forward, we shall be entitled to charge the User for any costs we may incur.

The User shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Your right to withdraw from the contract shall apply exclusively to those products that are returned in the same condition in which they were received. No refund will be made if the product has been unpacked, used beyond the mere opening of the container package, products that are not in the same condition in which they were delivered or have suffered any damage, so the User must be careful with the product(s) while they are in their possession. Please, the original packaging, labeling and instructions and other documents that may accompany the product must be returned along with the product, as well as the ticket that you will have received at the time of delivery of the product duly completed, if applicable.
After examining the item we will inform the User if he/she is entitled to a refund of the amounts paid. The User shall bear the cost and risk of returning the products to us. For any questions, please do not hesitate to contact us through our contact form.
Return of Defective Products
Any product delivered must be carefully checked by the User and, in the event of anomalies, partial or total deterioration and/or absence of any of the products in the order, the User must make the appropriate observations on the carrier’s invoice or at the e-mail address: . info@tempting.es within a period not exceeding 2 days from receipt. If the User considers that at the time of delivery the product does not conform to the stipulated in the conditions of purchase, he/she should contact us immediately by e-mail providing information about the product data, as well as the damage it suffers.
If no observations are made, the product is considered to have been delivered in good condition and may not be the subject of any subsequent claim for this item.
The User may return the product by sending it to the address indicated on the ticket received with the product at the time of delivery. We will proceed to carefully examine the returned product and will inform you by e-mail within a reasonable period of time whether the refund or replacement of the product (if applicable) is appropriate. The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days from the date on which we send you an e-mail confirming that the refund or replacement of the non-conforming item is appropriate.
The amounts paid for those products that are returned because of any defect or defect, when it actually exists, will be refunded in full, including delivery charges incurred to deliver the item and the costs you would have incurred to return it to us. The refund will be made by the same means of payment that was used to pay for the purchase.
In any case, the rights recognized by the legislation in force shall remain unaffected.

The products are deemed to be in conformity with the contract provided that (i) they conform to the description made by us and possess the qualities that we have presented on this website, (ii) they are fit for the uses to which products of the same type are ordinarily put and (iii) they present the quality and performance usual for a product of the same type that are reasonably to be expected.
In this sense, if any of the products do not comply with the contract, you must inform us following the procedure detailed in the previous section and through any of the means of communication provided for this purpose.
Except as otherwise provided in these Conditions, our liability in respect of any product purchased from our website is strictly limited to the purchase price of such product. However, unless otherwise provided by law, we will not accept any liability for the following losses, regardless of their source:

We shall not be liable for any failure or delay in the performance of any of the obligations assumed, when the same is due to events beyond our reasonable control (“Force Majeure Cause”).
Force Majeure Causes shall include any act, event, failure to exercise, omission or accident beyond our reasonable control.
Obligations shall be deemed to be suspended for the period during which the Force Majeure Event continues, and we shall have an extension of time to perform such obligations for a period of time equal to the duration of the Force Majeure Event. We will use all reasonable efforts to bring the Force Majeure Event to an end or to find a solution that will allow us to perform our obligations despite the Force Majeure Event.
Our failure to require your strict performance of any of your obligations under any agreement or these Terms or our failure to exercise any rights or remedies to which we may be entitled under any such agreement or these Terms shall not constitute a waiver or limitation of such rights or remedies or relieve you from any such obligations.
No waiver by us of any particular right or remedy shall constitute a waiver of any other right or remedy arising under a contract or the Terms. No waiver by us of any of these Terms or of any rights or remedies arising under a contract shall be effective unless it is expressly stated to be a waiver and is given and communicated to you in writing in accordance with the Notice section above.
If any of these Conditions, or any provision of a contract, should be declared null and void by a final decision issued by a competent authority, the remaining terms and conditions shall remain in force, without being affected by such declaration of nullity.
These Terms and any document expressly referred to in these Terms constitute the entire agreement between you and us relating to the subject matter hereof and supersede any prior covenants, agreements or promises made between you and us orally or in writing.
We have the right to revise and modify these Terms at any time.
You will be subject to the policies and Conditions in effect at the time you use this website or place each order, unless we are required by law or governmental agency decision to make retroactive changes to such policies, Conditions or Privacy Statement, in which case any such changes will also affect orders previously placed by you.
